What is Employer Retaliation in California?

As we have discussed in previous posts, retaliation occurs in many California workplaces, even though it is against federal and state law. Who is protected from retaliation in California? 
Under California and federal law, employees, applicants for employment, and former employees are protected from employer retaliation.

 

What is a protected right? Again, you cannot be retaliated against for exercising a protected right. In California, protected rights may include:- threatening to file a charge of employment discrimination;

- complaining to a supervisor about unlawful discrimination;

- participating in a legal proceeding, like a deposition or court case, in a manner that affects your employer’s legal rights, such as by testifying against them;

- defending yourself against charges of sexual harassment, unless you were found guilty;

- refusing to obey an order you reasonably believe to be discriminatory or illegal.
